Terms of Service

These terms govern your use of Ally ("the Service"), operated by John Seery, trading as AllOnOurOwn ("we", "us", "our") at app.allonourown.com.

By creating an account, you agree to these terms. If you do not agree, do not use the Service.

1. The Service

Ally is an AI-powered executive productivity tool. It helps you manage actions, notes, commitments, relationships, and other work data. AI features are powered by third-party providers (see our Privacy Policy for details).

The Service is provided for organisational and productivity purposes only. We do not guarantee that the Service will meet all user requirements or that it will operate without interruption.

2. Accounts

2.1 Eligibility

You must be at least 16 years old and have the authority to enter into these terms.

2.2 Account Security

You are responsible for maintaining the security of your account credentials. You must use a strong password. Notify us immediately at security@allonourown.com if you suspect unauthorised access.

2.3 One Account Per Person

Each account is for a single individual. You may not share account credentials.

2.4 Account Suspension

We may temporarily suspend accounts to investigate security issues, abuse, or violations of these terms. We will notify you promptly and restore access once the investigation is complete, unless a violation is confirmed.

3. Your Data

3.1 Ownership

You own all data you create in Ally. We do not claim any intellectual property rights over your content.

3.2 Export

You may export all your data at any time in JSON format. We will never restrict your ability to export your own data, regardless of your subscription status.

3.3 Deletion

You may delete your account and all associated data at any time via Settings. Deletion is permanent and cannot be undone. Deleted data may remain in secure backups for up to 30 days before permanent removal.

3.4 AI Processing

Some features send your data to third-party AI providers (OpenAI) for processing. You must explicitly consent to this before using AI features. You can revoke consent at any time.

AI outputs may contain inaccuracies or incomplete information. You should independently verify important information before relying on it.

3.5 Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the EU General Data Protection Regulation (GDPR).

Where Ally processes personal data on your behalf as part of the Service, you remain the data controller and we act as a data processor solely for the purpose of providing the Service.

3.6 Your Responsibility

You are responsible for ensuring you have the right to store or process any information you upload to the Service. This includes information about third parties (such as colleagues, contacts, or meeting participants) that you enter into Ally.

Automated access via public APIs is permitted where explicitly supported by the Service.

5. Service Availability

5.1 Best Effort

We provide the Service on a "best effort" basis. We do not guarantee 100% uptime.

5.2 AI Features

AI features depend on third-party providers (OpenAI). If their service is unavailable, AI features may be temporarily unavailable. Manual features are not affected.

5.3 Service Modifications

We may modify, suspend, or discontinue parts of the Service at any time. Where changes materially affect paid users, we will provide at least 30 days' notice.

6. Pricing and Payment

The Free tier provides limited AI features at no cost. Premium subscriptions are billed monthly via Stripe. We do not store your payment card details. You may cancel at any time and retain access until the end of your billing period. We offer a full refund within 14 days of your first Premium subscription.

7. Intellectual Property

The Service, including its software, design, and branding, is owned by John Seery, trading as AllOnOurOwn.

8. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties. We are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid us in the 12 months preceding the claim. AI features provide suggestions, not professional advice.

9. Force Majeure

We are not liable for failure or delay in performing our obligations due to events beyond our reasonable control, including outages of third-party infrastructure, natural disasters, governmental actions, or internet disruptions.

10. Indemnification

You agree to indemnify us against any claims arising from your use of the Service, your content, or your violation of these terms.

11. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these terms, with notice where practicable. We will provide an opportunity to export your data before deletion except in cases of serious abuse.

12. Dispute Resolution

In the event of a dispute, both parties agree to first attempt to resolve the matter informally by contacting support@allonourown.com. If not resolved within 30 days, either party may bring proceedings in the courts of Ireland.

13. Changes

We will notify you by email at least 30 days before material changes take effect.

14. Governing Law

These terms are governed by the laws of Ireland. Any disputes will be subject to the exclusive jurisdiction of the courts of Ireland.
